These Terms of Use ("Terms") govern your access to and use of Loan App: Cash Advance by JST and related online services operated by Cash Advance by JST Inc. ("Company," "we," "our," or "us"). By using the Services, you agree to be bound by these Terms and any additional policies incorporated by reference.

Your Agreement to These Terms

By downloading, accessing, registering, or using the Services, you confirm that you are at least 18 years old (or the age of majority in your state), are legally able to enter binding agreements, and will comply with applicable law. If you do not agree to these Terms, you must discontinue use of the Services.

1. Platform Function and No Lending Relationship

The Services provide informational and marketplace functionality. We are not a lender, creditor, loan broker, bank, or financial advisor. We do not fund loans, make underwriting decisions, set final rates, or control final lender approval outcomes. Any loan product is offered solely by independent third-party lenders under their own legal terms.

2. Eligibility, Capacity, and Account Integrity

You represent that you are legally capable of entering into binding agreements and that all information you provide is truthful, current, and complete. You agree to maintain the accuracy of submitted data and not to impersonate any person or entity.

Account Security and User Responsibility

You are responsible for safeguarding login credentials and for activity conducted through your account. If you suspect unauthorized access, credential compromise, or misuse, you must notify us promptly so we can apply appropriate protective controls.

3. User Conduct and Restricted Activities

  • No unlawful use, fraudulent activity, or attempts to evade verification controls.
  • No scraping, automated extraction, reverse engineering, or unauthorized probing of security controls.
  • No introduction of malware, malicious scripts, abusive traffic, or disruptive payloads.
  • No unauthorized commercial resale of Service output or branding elements.
  • No submission of another person’s personal data without lawful authorization.

7. Intellectual Property and Limited License

All trademarks, service marks, software, interface designs, layouts, graphics, text, and compilations in the Services are owned by or licensed to the Company. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial use in compliance with these Terms.

8. Communication Consent and Electronic Notices

By using the Services, you agree to receive operational and legal notices electronically, including via email and in-product messaging, where permitted by law. You are responsible for maintaining current contact details and for reviewing notices promptly.

Compensation and Partner Relationships

We may receive referral, marketing, or technology compensation from third-party partners when users are matched or routed through marketplace flows. Such compensation does not alter the legal requirement that lenders disclose final terms and comply with applicable lending and consumer-protection laws.

9. Service Availability and Modification Rights

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, for maintenance, compliance, risk mitigation, or business reasons. We are not liable for interruptions, delays, or feature removal to the extent permitted by law.

10. Warranty Disclaimer

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Cash Advance by JST Inc. and its affiliates, officers, directors, employees, contractors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, or business interruption. Where a direct liability cap is legally permitted, aggregate liability is limited to one hundred U.S. dollars (USD $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against any claims, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Services, or violation of law or third-party rights.

13. Compliance, Investigations, and Enforcement

We may investigate suspected violations and cooperate with law enforcement where legally required. We reserve the right to suspend or terminate access, block traffic, remove content, or take other protective actions where misuse or security risk is identified.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where another jurisdiction’s laws are mandatorily applicable. Venue for disputes shall be in courts of competent jurisdiction in Colorado unless otherwise required by law.

15. Dispute Resolution and Class Action Waiver

Before formal proceedings, parties should attempt informal resolution by written notice. Where enforceable and not prohibited by law, disputes may be resolved on an individual basis through binding arbitration rather than class litigation. Class, collective, and representative actions are waived to the maximum extent allowed by law.

16. Severability and Entire Agreement

If any provision is found unenforceable, remaining provisions remain in effect to the maximum extent permitted. These Terms, together with referenced policies, constitute the entire agreement between you and the Company regarding the Services.

17. Updates to Terms

We may update these Terms periodically. Revised Terms become effective upon posting unless a different date is required by law. Continued use after effective date constitutes acceptance of the revised Terms.
